How can I get a Work Visa in the USA?

Through an Employer

To obtain a work visa in the USA, you would typically need to have a job offer from a U.S. employer who is willing to sponsor you. The employer would then need to file a petition on your behalf with U.S. Citizenship and Immigration Services (USCIS). The specific type of work visa you apply for would depend on your occupation, qualifications, and the nature of the job.

Some common types of work visas in the USA include H-1B visas for specialty occupations, L-1 visas for intracompany transfers, O-1 visas for individuals with extraordinary ability, and work visas for agricultural or seasonal workers.

It's important to research the specific requirements for the type of work visa you are interested in and work closely with your employer and possibly an immigration attorney throughout the application process.

Through a Family Member who is an Immediate Relative or Priority Relative

To get a work visa through a family member, the family member must file an Alien Relative Petition for you and you must file to adjust status in the United States. You can apply for an Employment Authorization Document at the same time that you file to adjust status. If you are outside the United States you need to file for an immigrant visa. If the visa is granted you will enter the United States as a lawful permanent resident (LPR). As an LPR you do not need an EAD to work.

It is important to know that as an immigrant who entered the USA with inspection and a visa, adjusting status through a USC spouse, you are forgiven for working without authorization or without an EAD work visa permit. However, you are not forgiven for not paying taxes on your employment. You can apply for an ITIN through the Social Security Administration and pay taxes even though you are in the USA as an overstay or unlawfully present.
