Jacksonville Divorce Lawyer |I-864 Enforcement Defense

You probably found this page on my website because you are a United States Citizen who married an immigrant. You petitioned for the immigrant to come to the United States as a Lawful Permanent Resident and you agreed to support the immigrant financially. You paid the filing costs and attorney fees for the immigrant to come to the USA Your spouse in now a United State Permanent Resident. The marriage isn’t working out and now he or she is suing you for support based on the I-864 Contract that you signed.

There are five terminating events that terminate the I-864 Affidavit of Support Contract. The terminating events are a part of the contract. This means that nothing else will terminate the contract. Four of those events are pretty clear and there is no argument. However there are defenses to the enforcement of the I-864 Affidavit of Support based on one of the five terminating events and the terms of the other terms of the contract other than the terminating events . There may be defenses that totally terminate your obligation and there may be defenses that limit your obligation.

A lawsuit based on the I-864 contract, whether it is pursuant to divorce in state court or breach of contract in federal court is more about contracts than it is about immigration. It is based on a federal statute. State courts have no authority to alter the terms of the contract.

I have more than 30 years experience. The I-864 Affidavit of Support is an area that I focus on. I have spent countless hours researching the contract. I am licensed to represent you in all Florida State Courts and in the Middle District of Florida Federal Court. I can be admitted to all Federal and State Courts in the United States to represent you.

Before agreeing to represent you I will conduct a thorough review of your situation to determine your defenses. I will let you know whether you have defenses to enforcement. It is a pre occasion when a person has no defenses. You may have defenses that eliminate some or all of your obligation. I charge a minimal fee for review of your situation to determine your defenses. The fee will vary depending on factors to be determined during our initial telephone consultation. In the past, the fee to review a situation has been  $200.00 to $3,000.00.

I will also let you know the fees and estimated costs should you choose to retain me as your attorney.
