Abuse can be physical, emotional or psychological. It is often a combination of all three . A spouse that refuses to work with you to get your green card or work visa is an abusive spouse.

What is VAWA:

VAWA is the Federal Violence Against Women Act (VAWA), Under this act, a foreign national may be eligible to become a lawful permanent resident (get a Green Card) if s/he has been or is the victim of battery or extreme cruelty committed by:

  • A U.S. citizen spouse or former spouse;

  • A U.S. citizen parent;

  • A U.S. citizen son or daughter;

  • A lawful permanent resident (LPR) spouse or former spouse; or

  • An LPR parent.

The title is misleading. Anyone, regardless of sexual identity, may qualify for VAWA.

Am I Eligible for VAWA?

The VAWA Petition is a substitute for the Alien Relative Petition. You may file a VAWA Petition if you are the Spouse Parent of Child of the Abuser.

  • Spouses: You may file for yourself if you are, or were, the abused spouse of a U.S. citizen or permanent resident. You may also file as an abused spouse if your child has been abused by your U.S. citizen or permanent resident spouse. You may include on your petition your unmarried children who are under 21 if they have not filed for themselves;

  • Parents: You may file if you are the parent of a U.S. citizen who has abused you;

  • Children: You may file for yourself if you are unmarried, under 21, and have been abused by your U.S. citizen or permanent resident parent. You may also include your children on your petition. You may file for yourself as a child after age 21 but before age 25 if you can demonstrate that the abuse was the main reason for the delay in filing.

The Process

The VAWA Petition is filed first. You must provide sufficient supporting documentation to show that you have been the victim of abuse by a USC or LPR spouse or parent. Gathering the supporting documents and presenting a sufficient memorandum of law is where Kyndra L Mulder, Esquire comes in. You may file to adjust status concurrently with the VAWA Petition. You will only be eligible for Employment Authorization if you have filed to Adjust Status. 

First; There is no fee for filing for VAWA. You will receive a receipt showing that your petition has been received.

Second: You will receive an appointment for your biometrics.

Third: You will receive a notice whether you have established a prima facie case.

Fourth: You will receive your EAD (if you have filed the Application to Adjust Status.

At any time in the process you may receive a request for additional evidence (RFE). This is not a negative sign. A USCIS Officer is reviewing your application and does not have an opportunity to ask you questions or request additional evidence from you. The RFE is the officers way of getting answers to any questions s/he may have. The RFE is common in a VAWA petition. Often a petitioner will not have supporting documentation for every statement. Abusers can be skilled at covering their tracks. Kyndra L Mulder, Esquire is experienced in assisting you in gathering the support you need.

Mulder Law has never been required to attend an interview for a VAWA Petition. My clients have been granted VAWA without an interview. Clients have always received their green cards in the mail.
